Filing a labour complaint after resignation in the UAE

Can you file a MoHRE complaint after resigning, after visa cancellation or after leaving the UAE? Deadlines, dues you can claim and what happens next.

Yes. Resigning does not end your right to your final dues, and you can file a labour complaint with the Ministry of Human Resources and Emiratisation (MoHRE) if they are not paid. Article 53 of Federal Decree-Law No. 33 of 2021 gives the employer 14 days from the end of the contract to pay your wages and all other dues. MoHRE's guidance says a complaint can be filed within 30 days of the employer's breach, and the law bars court claims two years after the employment relationship ends. As of October 2026, MoHRE's pages do not explain how to file from outside the UAE, so act before your visa is cancelled or you leave.

Who this guide is for

This guide is for private-sector employees in mainland UAE and non-financial free zones registered with MoHRE who have resigned, served or skipped notice, and are still waiting for final pay. It also covers people whose residence has been cancelled and people who have already left the UAE.

To check that your resignation was valid, see our guide on resignation notice period rules. For the full list of exit items, see our visa cancellation and final settlement checklist. Domestic workers and DIFC and ADGM employees follow different rules and channels.

What can I still claim after resigning?

ItemWhat the law saysArticle
Final wagesAll wages up to the last day, paid within 14 days of the contract endingArticle 53
Unused annual leavePaid for days not taken, and for the part of the final year worked, on basic wageArticle 29(9)
Gratuity21 days' basic wage a year for the first five years, 30 days after that, once you have one year of continuous serviceArticle 51
Notice payOwed by the side that did not respect the notice period, based on the last wageArticle 43(3) and (4)
Ticket homePaid by the employer, unless you joined another employer or the contract ended for a reason attributed to youArticle 13(12)
Experience certificateFree, on request at the end of the contractArticle 13(11)

Resigning does not reduce gratuity under Article 51 of the current law. The notice rule works both ways, though. If you left before your notice ended without agreement, the employer may claim notice pay from you (Article 43(3)).

How long do I have to complain?

In practice, if nothing is paid by day 14, that is the breach, so aim to complain within 30 days after it. MoHRE's pages do not say what happens to a complaint filed after 30 days. If you are already past that point, ask MoHRE rather than assuming you are out of time, because the two-year court limit is separate.

Where the official sources differ. The UAE Government portal's labour dispute page (updated 12 August 2026) still says no claim is heard after one year from the date of the violation. The official Arabic text of Article 54(9), as replaced in 2024, says two years from the end of the employment relationship. The Arabic text of the law prevails, but file early so the difference never matters.

After visa cancellation or after leaving the UAE

What happens after I file?

  1. Amicable settlement. MoHRE's service page says a specialist contacts both sides, after consulting a legal adviser, to try to settle. If that fails, a meeting is set and you receive a text message. The stated service time is 14 working days, with no fee.
  2. Claims up to AED 50,000. Under Article 54(2), MoHRE decides the dispute itself. It also decides any claim, whatever the value, where a party fails to comply with an earlier MoHRE settlement. The decision has the force of an executive instrument. Either side can bring a case at the competent Court of First Instance within 15 working days of being notified, and doing so suspends the decision (Article 54(3)).
  3. Claims above AED 50,000. If settlement fails, MoHRE refers the dispute to court with a memo summarising both sides and its recommendation (Article 54(4)). Our guide on MoHRE court referrals explains what to do next.
  4. Court fees. Article 55 exempts workers' claims of up to AED 100,000 from court fees at every stage.

Step by step

  1. Fix your last working day. Keep your resignation letter, proof of delivery and any agreement shortening notice.
  2. List every amount due. Final wages, leave pay, gratuity, any notice pay owed to you and the ticket.
  3. Ask for the settlement in writing. Request a line-by-line breakdown before day 14.
  4. Count from day 14. If nothing arrives, note the date of the breach.
  5. Get free advice. MoHRE's Labour Claims and Advisory Call Centre is on 80084.
  6. File through MoHRE. Use the MoHRE website or app. The service page lists 600590000 for help (24/7) and 046659999 for following up.
  7. Do it before you leave. Ideally file while your residence and grace period are still valid.
  8. Answer MoHRE's calls. Attend the meeting and keep every text message and reference number.
  9. Watch the decision dates. A MoHRE decision can be challenged within 15 working days; a court referral must be registered within 14 days.

When to speak to a licensed lawyer

Many unpaid final settlements end at MoHRE. Advice may help if your claim is above AED 50,000, if the employer alleges misconduct or claims notice pay from you, if you have already left the UAE, or if you want to challenge a MoHRE decision in court. The free case check can help you set out the facts first, and CaseDaleel can introduce an independent licensed professional only if you choose.
